Terms of Service

This is a translation. If it differs from the Japanese version, the Japanese version prevails.

These Terms of Service (the "Terms") set out the conditions for using Family AI Tutor (Japanese name おうちのAI家庭教師, Chinese name 家庭 AI 私人教师; the "Service"), provided by Kissho Co., Ltd. ("we", "us"). You need to agree to these Terms to use the Service.

01Scope

These Terms apply to all dealings between us and users in connection with the Service.

The Privacy Policy, Children's Privacy Notice, Legal Notice (Act on Specified Commercial Transactions), Account and Data Deletion, and AI and Child Safety pages published on the Service form part of these Terms. Where they differ from these Terms, these Terms prevail unless stated otherwise.

02What the Service is

In the Service, an AI tutor called Catherine makes a learning plan for each learner, teaches lessons through conversation, and adjusts the next plan based on how the learner is doing.

The Service is a learning aid. It does not provide school education, qualifications, or teaching by human instructors, and it does not guarantee better grades or any other learning outcome.

03Accounts

  • You must be 18 or older to create an account. One account covers one family and can include several learners.
  • The person who creates the account (the "account holder") must give accurate information and keep it up to date.
  • The account holder is responsible for keeping the email address and password safe and must not let others use them. If you learn of unauthorised use, contact us immediately.
  • Accounts may not be lent, transferred, or sold.

04Learners under 18

  • When adding a person under 18 as a learner, the account holder confirms that they are that person's parent or other legal guardian and, as guardian, agrees to these Terms, the Privacy Policy, and the Children's Privacy Notice.
  • The account holder should supervise how minors use the Service and check whether AI-generated content suits them.

05AI-generated content

  • Learning plans, explanations, exercises, and feedback in the Service are generated automatically by AI and are not individually checked by a person.
  • AI-generated content may contain mistakes, inaccurate information, or content unsuitable for a particular learner.
  • AI-generated content is not a substitute for educational, medical, psychological, legal, or other professional advice. For matters of health, safety, or law, please consult a professional.
  • If you find inappropriate content, tell us as described in AI and Child Safety.

06Free trial

We may offer some lessons free of charge within limits we set. The content and number of free lessons follow what the Service shows and may change.

07Buying learning time and payment

  • Paid learning time is bought per learner, per subject. Plans (30, 90, and 365 days) and prices (tax included) are shown on the purchase screen and in the Legal Notice.
  • Payments are processed by our payment provider, Stripe. We do not store card numbers.
  • The contract is formed, and payment is taken, when you press "Confirm and pay" on the purchase screen.
  • Learning time can be used as soon as payment completes. If the subject still has time left, the new period starts the day after the current one ends.
  • There is no automatic renewal. You will not be charged again when a period ends.

08Cancellation and refunds

  • Because this is a digital service, payments cannot be cancelled or refunded once completed.
  • However, if we cannot provide the Service for reasons attributable to us, we will refund the unused days on a pro-rata basis.
  • For refunds, contact us as described in section 20.
  • Purchases made through an app store are subject to that store's refund policy.

09Prohibited conduct

You must not:

  • break the law or public order and morals
  • infringe anyone's rights, interests, reputation, or privacy
  • place excessive load on our servers or network, or otherwise interfere with the Service
  • access the Service without authorisation, reverse-engineer it, or get around purchase or access-period checks
  • copy, republish, sell, or otherwise commercially use the Service's content without permission
  • lend or transfer an account, or resell access
  • enter input intended to make the AI produce illegal or harmful content
  • do anything else we reasonably consider inappropriate

10Content you enter

  • You keep the rights to the learning goals, conversations, answers, and other content you enter ("User Content").
  • You allow us to store, copy, process, and otherwise use User Content to the extent needed to provide, maintain, and improve the Service. We do not use it for purposes unrelated to the Service.
  • Do not enter content that infringes anyone else's rights.

11Intellectual property

Copyright and other intellectual property in the Service (other than User Content) belong to us or the rightful owners. You may use AI-generated learning materials for learning within your family.

12Changes, interruptions, and ending the Service

  • We may change the Service or stop providing it after notifying users in advance. If we stop providing it, we will refund the value of any remaining access period.
  • We may interrupt the Service temporarily without notice for maintenance, failures, natural disasters, or other unavoidable reasons.

13Suspension

If you breach these Terms, we may suspend your use of the Service or delete your account without prior notice.

14Closing your account

The account holder may stop using the Service at any time. Closing an account and handling the data follow Account and Data Deletion.

15Limitation of liability

  • We do not guarantee that the Service fits any particular purpose, that AI-generated content is accurate and complete, or that the Service will run without interruption.
  • If our breach of contract or tort causes you loss, then except where we acted intentionally or with gross negligence, our liability is limited to the total fees you paid us in the 12 months before the day the loss occurred.
  • The limit above does not apply where we acted intentionally or with gross negligence. Where the Consumer Contract Act of Japan or other laws do not allow our liability to be limited, those laws apply.

16Personal information

We handle personal information in accordance with the Privacy Policy and the Children's Privacy Notice.

17Changes to these Terms

  • We may change these Terms under Article 548-4 of the Civil Code of Japan.
  • When we do, we will show the new Terms and their effective date on the Service, or email account holders, a reasonable time before the change takes effect.
  • For changes that significantly affect your rights or obligations, we will ask for your agreement again in the Service.

18Governing law and jurisdiction

These Terms are governed by the laws of Japan. The Tokyo District Court has exclusive jurisdiction as the court of first instance for disputes relating to the Service.

19Language

The Japanese version of these Terms is the original. The Chinese and English versions are translations for reference; if they differ, the Japanese version prevails.
